Terms of Service

These Terms of Service ("Terms") govern your use of the websites, applications, and services operated by Xon Designs LLC ("Xon Designs," "we," "us," or "our"), a Texas limited liability company. By accessing or using our products, you agree to be bound by these Terms.

1. Services

Xon Designs develops and operates software products including but not limited to: CheckSix (web application), Raytr (iOS application), and Idle Tower Inc. (iOS application). Each product may have additional terms specific to its use, which supplement these Terms.

2. Eligibility

You must be at least 13 years old to use our services. If you are under 18, you must have the consent of a parent or legal guardian. By using our services, you represent that you meet these requirements.

3. Accounts

Some services (such as CheckSix) may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Interfere with or disrupt the integrity or performance of our services.
  • Reverse engineer, decompile, or disassemble any part of our software.
  • Use automated tools to scrape, crawl, or extract data from our services without permission.

5. Intellectual Property

All content, code, designs, trademarks, and other intellectual property in our products are owned by Xon Designs LLC or its licensors. You may not copy, modify, distribute, or create derivative works from our products except as expressly permitted.

6. In-App Purchases & Subscriptions

Some products offer optional in-app purchases or subscriptions. iOS app purchases are processed by Apple and subject to Apple's terms. Web service subscriptions are processed by our payment processor (Stripe) and subject to their terms. Refund policies follow the respective platform's policies.

7. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that our services will be uninterrupted, error-free, or secure.

CheckSix provides pay calculations based on user-entered data and published CBA rates. These calculations are for informational purposes only and should not be relied upon as the sole basis for grievance filings or legal action without independent verification.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XON DESIGNS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold harmless Xon Designs LLC, its members, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services or violation of these Terms.

10. Termination

We may suspend or terminate your access to our services at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination (including limitations of liability, indemnification, and dispute resolution) will survive.

11. Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or our services shall be resolved through binding arbitration in Texas, administered under the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

12. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted here with an updated effective date. Your continued use of our services after changes constitutes acceptance of the updated Terms. For material changes, we will provide notice through the applicable service or via email.
